Terms & Conditions

BOOKING TERMS & CONDITIONS:

This document sets out the Terms and Conditions of your WoW Ski Tours holiday booking. Your booking with us shall be governed by and construed in accordance with Scots Law and is subject to the jurisdiction of the Scottish Courts. Once your booking is confirmed by email a definite contract exists between us and all these terms and conditions become binding on us both. By making the booking you guarantee payment to us of the total cost of the holiday booked, and do so on behalf and with the consent of all others for whom the booking is completed. A deposit of £299.00 per person is payable immediately to reserve a space on your selected tour. The balance of the holiday cost must be paid no later than 10 weeks before departure. If the balance is not paid on time we reserve the right to cancel your booking and your deposit will be forfeited. We do not usually send reminders of monies owing.

Our prices do not include:

• Flights
• Travel Insurance. Check the terms of your travel insurance regarding piste closure
• Dolomiti Superski Pass
• Ski Hire / Equipment – If required
• Lunch
• Dinner – Evening meals are included with half board accommodation
• Drinks
• Additional charges that hotels will make for certain facilities such as sports facilities, entry to swimming pools, saunas, garage, parking costs etc.
• Extra Activities
• Local Expenses – e.g. resort / tourist taxes

 

Special Requests:
If you have a special request please indicate so at the time of booking and we will try to accommodate it where possible. We must point out that these requests cannot be guaranteed and any additional costs will be charged back to you.

Name Transfer:
You may transfer their booking to a third party provided we are notified not less than 7 days prior to the scheduled departure date, and payment has been made in full.

Cancellations:
Should you or any member of your party need to cancel your booking, you must do so in writing. Once your cancellation has been confirmed, the charges you incur, which are set out below, depend on when we receive your written notification.
Please note that you should check the terms of your travel insurance to ensure cover against cancellation.

Cancellation Charges:
• Cancellation made more than 10 weeks before the departure date: you forfeit the deposit;
• Cancellation made 0 days to 10 weeks before the departure date: you forfeit 100% of invoice
• No show on the departure date: you forfeit 100% of invoice

*All our tours are subject to a minimum number of bookings and we therefore reserve the right to cancel your booking should the numbers for your chosen tour not be sufficient. In this event we will return all monies which you have paid.

Force Majeure:
We cannot be held responsible for cancellations or curtailment caused by reason of war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disaster, fire, World Health Organisation or Foreign office advice, adverse weather conditions, closure or congestion of airports or ports, cancellation or changes of schedules by airlines and all events beyond our control. Nor can we accept responsibility where the performance or prompt performance of our contract with you is prevented or affected as a result of such circumstances beyond our control.

Behaviour:
We reserve the right at our absolute discretion to terminate without notice and liability the holiday arrangements of any person whose behaviour is such that it is likely, in our reasonable opinion, or that of the owner or manager, to cause distress, danger, damage, or annoyance to other customers, employees, property or to any third party. In all cases full cancellation charges apply and we will be under no obligation whatsoever for any cost incurred.

Our Liability:
We promise to make sure that all parts of the holiday we have agreed to arrange as part of our contract are provided to a reasonable standard and in accordance with that contract. However, please note that we will not be liable for any injury, illness, death or consequent losses suffered by you or any member of your party unless you are able to prove that such injury, illness, death or consequent loss was caused by a lack of reasonable care and skill on the part of ourselves or our suppliers.
And in all claims of whatever nature we will not be liable where the alleged loss or damage results from any of the following.

(a) the fault of the person(s) affected or any member(s) of their party; or
(b) the fault of a third party not connected with the provision of your holiday which we could not have predicted or avoided; or
(c) an event or circumstances which we or the supplier of the service(s) in question could not have predicted or avoided even after taking all reasonable care (see Force Majeure).
(d) the fault of anyone who was not carrying out work for us (generally or in particular) at the time.

In addition, we will not be responsible (i) where you do not enjoy your holiday or suffer any problems due to something you did not tell us about when you booked your holiday and where the problems you suffered did not result from any breach of our contract or other fault of ourselves, our suppliers or agents or (ii) where any losses, expenses, costs or other sum you have suffered relate to any business.
Please note, we cannot accept responsibility for any services which do not form part of our contract.

Hazardous Activities:
In the interests of safety, you are advised to wear appropriate clothing and footwear at all times.
If you choose to participate in skiing or any of the various sports/activities available in many ski resorts eg. snowmobiling, bobsleigh etc. please note that some of these are classified as hazardous activities and are not / may not be covered by your holiday insurance. You should ask your insurer’s representative for advice on these but any participation is at your own risk.

Assistance:
Should you suffer, through misadventure, illness, personal injury or death whilst on holiday as a result of an activity not part of the holiday arrangements made by us or not purchased locally through us we will offer you all reasonable assistance in pursuing any claim you intend making against the offending party. This includes advice and guidance and may include a contribution towards initial costs and expense which in our opinion is reasonable and appropriate in the circumstances.
Please advise us of any particular facilities that are important to you at time of booking your holiday. Some facilities and excursions may not be available at certain times if e.g. it is the beginning or the end of the season. This may include, après ski facilities or hotel facilities. Hotels may make charges, payable locally, for such facilities. Please note that many pictures from sales or hotel or resort brochures may not be accurate and may be included for their pleasantness and general relevance.

If you opt for Hotel Accommodation:
All reasonable and proper steps have been taken to ensure that the accommodation and services are as advertised. We will be responsible for any acts or omissions of our own employees and agents whilst acting within the scope of their employment but cannot be responsible for the acts or omissions of those providing services over which we have no direct control.
In Italy a twin is commonly accepted as referring to two separate mattresses and duvets contained in one large frame. Some rooms may take an extra bed if required. These extra beds may be bunk beds, fold-away beds or sofa beds. Where an extra bed is added this may limit the space available. Single rooms do not always match up either in size or facilities to twin bedded rooms. Please note that access to and from some rooms may be by stairway only.
‘Private facilities’ are not necessarily ‘en suite’
Meal Arrangements:
Half board means the first meal you will receive will be dinner on the day of your arrival in the resort and the last meal will be breakfast on the morning of your departure from the resort. Clients arriving late will normally receive a cold meal.

Complaints:
In the event of any problems arising during the course, you must report it immediately to our representative on the course and failing satisfactory resolution of the problem, you should file a written report within 28 days of your return. No liability will be accepted for any complaint not reported to our representative at the time and intimated within 28 days thereafter.

Data Protection:
Any information that you give to us is used solely for the purpose of arranging your holiday. If you subscribe to our e-mail newsletter or ask to receive a copy of our annual brochure, then your details will be kept on record and used for this purpose only. We do not use your information in any way that contravenes the Data Protection Act.

Marketing:
We do not share any information with third parties, but we would like to hold your information, where collected by us, for our own future marketing purposes (for example to inform you of promotional offers or to send you our brochures). If you do not wish to receive such approaches in the future, please inform us as soon as possible.

Images / Testimonials / Reviews / Social Media:
Any images taken during your trip can / will be used on our website or social media platforms unless you inform us otherwise.

Testimonials / Reviews:
Any testimonials / reviews taken during / after your trip can /will be added to out website unless you inform us otherwise.

Insurance:
You must take out the travel insurance providing adequate cover for the characteristics of your holiday including cover for cancellation charges, the cost of assistance, including repatriation, should you have an accident or become ill or if your return journey is delayed. Our staff are not qualified to advise you in detail about insurance cover and any specific queries should be addressed to an insurance broker.

Travel Documents:
All travellers need valid passports.
It is your responsibility to ensure that you have the correct travel documents for your holiday. If you are a UK citizen, a valid passport and no visa is required for travel to Italy at time of going to print.
If you are a NON European citizen you may require a valid visa for travel to Italy.
You should also take your European Health Insurance Card (applications available from the Post Office or apply online at www.ehic.org.uk).

Your Health and Fitness:
All persons taking part in sporting activities should be in good health and have a level of fitness suitable for doing the chosen sport. You must advise us in advance of any disability, medical condition (including pregnancy) or behavioural problem experienced by you or any member of your party. We reserve the right for ourselves, reps, employees and agents to refuse participation to any person if, in our opinion, that person is not fit for whatever reason (including by influence of drugs or alcohol) to participate in that sport or activity. No refunds will be given to people who are refused participation in a sport under this clause.

Medical Conditions and Disabilities:
If you or any member of your party have any medical problem or disability which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at time of booking by completing the Client Information Form available on request by calling our Booking Hotline. You must also promptly notify us of any deterioration or adverse change in or development of any medical conditions or disability which may affect your holiday. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline the booking or, if full details are not given at the time of booking, cancel when we become aware of these details.

Safety Standards:
Safety standards in some countries may not reach the same level of those enjoyed in the UK. We therefore advise clients to take all reasonable precautions whilst on holiday and, in particular, to familiarise yourself with fire escape routes. We would urge you to study the resort and hotel descriptions carefully to identify sources of noise which exist or might expect to exist, i.e., roads, bars, discos, etc. However, it is impossible to predict noise created by individuals, machinery or traffic, i.e. temporary noise disturbances.

The Skiers’ Code of Conduct (FIS Rules)
These are important to you as they make skiing safer for you and others. We expect you to follow these rules during your holiday.

Resort Activities:
Activities referred to on web pages as ‘available’ are not organised by us nor can we guarantee they will be available. Furthermore we consider some of these activities to be hazardous and we can take no responsibility in respect of them.

Travel Advice:
The Foreign & Commonwealth Office Travel Advice Unit may have issued information about your holiday destination. You are advised to check the FCO website.

Health Advice:
Please refer to the Department of Health website for up to date advice.

Finally, we hope you have a very safe and enjoyable holiday with us and return next year to renew our acquaintance.

 

The contract, of which this forms part, shall be governed by the law of Scotland.
